STOP HUMAN RIGHTS VIOLATION AND UNION BUSTING"

SBY-Budiono Regime Failed To Fullfil and Protected Human Rights For All Indonesia Workers and Peoples

Investigate Human Rights Past Violation thoroughly And Restore Those Who were  Enforced Disappearance

Solidarity Greetings,

Recognition of the rights of Independence, Justice and Humanity has been declared by all the nations through the Universal Declaration of Human Rights which was proclaimed on December 10, 1948. Universal Declaration of Human Rights recognizes that every human being has the same dignity and rights on social, culture, economic, and political must be guaranteed and protected by the State. Every person has the right to decent living, the right to decent work and away from slavery in any form, the right to a fair and decent wage, the right to freedom of assembly and Freedom of Association without the pressure and violences. The right to housing, education and decent health care. The Universal Declaration which is the important milestones of the struggle for compliance and enforcement of Human Rights, which became the duty of the State to fullfil all the people's basic rights as stated in the Universal Declaration of Human Rights.

Today 62nd Anniversary of Human Rights Day this time in the Imperialism crisis situation is more acute and intensified. Gluttony and greed  the imperialist countries to robbing Indonesia natural wealth as semi-feudal and semi colonial, has left the suffering and damage the lives of Indonesian people especially the workers and peasants as a the people majority.

The global economic crisis that was born due over production from the giant corporations of the imperialist, especially in high-tech goods and military weaponry on the one hand, while on the other hand the gap economic development between developed countries (imperialist) with retarded countries in particular the semi feudal dan semi colonial. The global economic crisis has caused more loss of popular sovereignty, peace, and freedom  which is the basic joints of respect, protection and fulfillment of human rights. Large corporate greed sustained political system that does not democratic in the accumulate a great advantage in the economic order couse demage social, cultural including the environment.

For the Indonesia peoples, the situation on economic and the global financial crisis in the body of  imperialism has further aggravate the economic crisis in Indonesia. The Deficits of Trading and budget caused by low national production and a flood of imported goods and coupled with the burden of foreign debt payments that are very high, led to increased variety of basic needs and the loss of jobs for millions of workers in Indonesia.  This has also caused the dispossession of the people's lands and the monopoly on   resources of the people productive , hunger and malnutrition, and various forms of violence that is currently more widespread occur.

Developed countries, with all its superiority continues to strive to pressured and stated their dominance on developing and  retarded countries. Economic imbalances caused enormous loss of real economic carrying capacity. The Economic capacity of peoples in the transaction continues to weaken due to shifting economic pressures on the economy-centered into the financial system. This condition occurs due to the world community's income decreases due to economy accumulation of excessive and centered in big corporations. This condition causes a loss of peoples rights on better economy access

The economic crisis that occurred in the country can no longer be helped by the policies taken by the government. Of the various policies issued, none of which meets concrete foundations of respect and protection of basic rights of the people.  About wage policy, the policy about the liberalization of land, labor export policy questions and various other policies, such as raising prices in electricity tariff (TDL) would make life increasingly impoverished people of Indonesia and in danger of losing their basic rights. The impact of such a policy course to be not easy for the people.

Today people no longer get right to work and a decent wage, people no longer have the right to housing, including food and clothing, people no longer have access to education and decent health care because of increasing health costs and education, people no longer have the right to take part in cultural activities. The wage policy, the policy about the liberalization of land, labor export policy and various other policies, such as raising prices in electricity tariff (TDL) would make people's life increasingly impoverished  and in threatened losing their basic rights. The impact of such a policy be not easy for the people. Today people no longer get right to work and a decent wage, people no longer have the right to housing, including food and clothing, people no longer have access to education and decent health care because of increasing health  and education cost, people no longer have the right to take part in cultural activities.

For the Indonesia workers, the economic crisis has spawned exploitation and oppression more intensively, various fundamental rights of workers both economic and social rights as well as political rights have deprived in various forms by the employers who cooperate with the government. Deprivation of wages in many ways and forms (overt or covert) has been carried out by government and employers, so the wages received by workers from day to day, year to year further away from the need for decent living (real needs of workers). this is because the government continued to maintain low wages politics in determining the Provinces Minimum Wages and city (UMK/UMP). The use of short-term contract employment system, recruitment outsourcing labor, income taxes on that is charged to workers who have low wages, suspension of implementation of the wage in accordance minimum wages conducted by employers, as well as various other forms of wage cuts through the elimination or reduction of bonus money, the premium (production, performance, working period ), as well as other benefits is a real form of deprivation of wages conducted systematically.

The workers must also be confronted with no certainty of work, the mass layoffs,  occurred in all the cities in Indonesia, the application of short-term contract and outsource is clear evidence of deprivation of rights work undertaken by the government. Until mid-August 2009 alone for example Central Bureau of Statistics (BPS) noted the number of workers laid off about 3 million people (source: Kompas Media). Of course this will increase the number of unemployment in the same period, the figure is estimated to reach 8.59 million people, equivalent to 7.41% of total labor force that numbers 107 million people.

Other issues that are faced by the Indonesia workers is suppression of Trade Unions and no freedom of speech in public, although the government has ratified 17 ILO conventions, regarding protection  for workers and freedom of association, and also has issued Law No. 21 of 2000 Concerning Trade Union / Labor Union and Labor Law No. 13 of 2003. However, violent actions, such as beatings, terror, mutation labor and layoffs toward members and trade union leaders as well as criminalizing union leaders continue to occur. This proves that the Indonesian government to date has never been serious in enforcing the rights for the workers, because in reality there are no guarantees for the workers to be able to fight for a better life through the Trade Unions.

Situations and circumstances on experienced and faced by GSBI from since its establishment. Almost every time when organizing  and set up trade unions at the plant is always in the way blocked and destroyed by entrepreneurs with a variety of ways. Where almost 80% of establishment of trade unions at the plant is always accompanied by layoffs unilateral action against members and leaders of trade unions by employers with a variety of reasons and a series of other measures such as, mutation, Warning Letter (SP), are not given rations for overtime, terror and intimidation to resign from GSBI membership or dissolve the Independent trade union  that is have registration number according to law. In fact, there are also criminalize the practice of using criminal articles and campaign of anti independent union (GSBI) conducted openly.

The objective situation above make anniversary of world Human Rights Day this time has a significance for the workers. The situation when the universal declaration on  human rights recognition is increasing age, but on the contents of the universal declaration can not be perceived benefits for the workers, peasants and other poor peoples. The workers and also the people of Indonesia was even more difficult to defend the rights of economic, social and cultural and even still had to fight to get it because there was no guarantee and protection of the state.

From the above presentation of the facts from fundamental problems faced by the workers of Indonesia, is in fact a form of human rights violations committed by the government under a power of SBY's puppet regime. SBY-Budiono Failed to Fullfil and Protect human rights for the workers and the whole people of Indonesia. In the view of GSBI all these actions are concrete facts of human rights violations on basic rights of workers and Indonesia peoples, and  the SBY-Budiono regime have responsibility  to fullfil and resolve all the various forms of human rights violations that occurred during this.

Therefore, in order to 62nd anniversary Human Rights Day on December 10, 2010. Central Board of Federation of Independent Trade Union (DPP.GSBI) called on all Workers and Indonesia Peoples to jointly " FIGHTS AGAINST GRABBING ON WAGES, WORK AND LANDS, VARIOUS FORMS OF VIOLENCE, HUMAN RIGHTS VIOLATION  AND UNION BUSTING "
